According to a report from CNET, it seems that Samsung has no plans on taking this verdict lying down and are asking for a retrial. The company has filed a post-trial motion with the US District Court in San Jose, California, asking the court to either dismiss the judgement or to retry the case.
In the motion filed by Samsung, it claims that “no reasonable jury could have found that any of Apple’s asserted design patents was applied to Samsung’s entire accused smartphones.” Samsung is also claiming that the ruling was “excessive” and the the evidence presented in the trial “supports a verdict of no more than $28.085 million”.
Apple had previously demanded $1 billion in damages while Samsung argued that $28 million was more fair, in which the jury ultimately split the difference which resulted in the $539 million damages verdict. Whether or not Samsung will get their wish at a retrial remains to be seen, but it is clear that the company will not be giving up just yet.
