Brazilian YouTuber Convicted For Video Piracy ‘Tutorials’

These days with the number of videos uploaded onto YouTube, you can find tutorials for just about anything, from how to poach an egg all the way up to how to build your own home. There also exists tutorials for things that are illegal, like how to rip videos from websites, music, and so on, and for the most part no one has really gotten into any trouble, at least until now.

According to a report from TorrentFreak, it appears that Brazilian YouTuber Marcelo Otto Nascimento has recently been convicted for alleged creating tutorials that teach others how to pirate videos. Nascimento operates the YouTube channel Café Tecnológico, which began innocently enough with videos about baking bread, but later expanded to cover a variety of topics, such as how to stream videos without having to pay for it.

Unfortunately this caught the attention of local TV industry group Associação Brasileira de Televisões por Assinatura who took legal action against Nascimento, who argued in court that his videos merely comments on IPTV systems and does not breach copyright or represent unfair competition, but Judge Fernando Henrique de Oliveira Biolcati who presided over the case did not agree with his assertions.

According to the judge’s ruling, “[T]he plain intention of the defendant was to guide users in order for them to obtain access to the restricted content of the applicant’s associates….while gaining advantages for this, especially via remuneration from the providers of the mentioned applications (YouTube and Facebook), proportional to the volumes of visitors.”

As a result of the ruling and conviction, Nascimento had to remove all of his online content that could be deemed as instructional for pirates, and has also been prohibited from publishing any more videos of a similar nature, and is also expected to pay copyright holders for material damages that have yet to be determined.
