Samsung’s patent feud with Apple has been going on for a few years now, the company was found to infringe on several on Apple’s patents and ordered to pay $930 million. It was able to bring down the damages amount substantially in the legal proceedings that followed, and even though it decided to pay over $500 million to the company, it asserted its right to refund and in pursuit of that it’s going to this matter to the U.S. Supreme Court.
The company has asked justices to hear an appeal of its patent feud with Apple, it aims to have the 2012 jury verdict set aside that found it liable for infringing on some of Apple’s patents. Samsung has prayed to the court to review rulings considering “design patents.”
Samsung is of the view that lower courts have misapplied the law covering design patents which means to protect “ornamental” features which aren’t directly related to the product’s function, adding that U.S. District Judge Lucy Koh should have pointed out to the jury which parts of the iPhone design were ornamental and which were functional.
Even though Samsung is trying to reach out to the Supreme Court it can’t be said with certainty if the highest court in the land is going to take up this matter at all, a report points out that the Supreme Court hasn’t heard a case related to design patents in more than a century, so Samsung’s prayer has to really move a proverbial mountain for the Supreme Court to deem it worthy of its time.
