At that time Phan remained quiet about the lawsuit, but according to the BBC, Phan and her reps have since responded. According to one of her representatives, Ultra Records had apparently given Phan the right to use their music. “Ultra agreed to allow Michelle to use the music and Michelle intends to fight this lawsuit and bring her own claims against Ultra.”
Kaskade, one of the artists under Ultra Records, does not seem too pleased by the lawsuit, going as far as distancing himself from it and even tweeting his support for Phan, which she replied by thanking him. In the lawsuit, Ultra Records claims that Phan had profited from using their music without their permission, and are seeking as much as $150,000 in damages for each proven copyright infringement.
A rep for Phan added, “Michelle’s intention has always been to promote other artists, creating a platform for their work to be showcased to an international audience. Kaskade, whose music has been featured in Michelle’s videos, has publicly defended Michelle against Ultra’s claims and acknowledges the success he’s gained from her support.”
